Terms of Service

The agreement between you and Oversteer Labs LLC when you use trackReg, as a driver or as a club.

Effective October 28, 2026

1. The agreement

These terms are an agreement between you and Oversteer Labs LLC (“trackReg”, “we”, “us”). By creating an account or using the trackReg website, apps or services, you agree to them. If you use trackReg for a club, you agree to them for that club and confirm you may bind it. Our Privacy Policy, SMS terms, Refunds and cancellations and pricing terms are part of these terms.

2. What trackReg is

trackReg is software that motorsport clubs use to publish events, take registrations, collect waivers and payments, and run event day, and that drivers use to find and enter those events. trackReg does not organize, host, insure or supervise any event. Each event is run by the club that lists it, and that club is responsible for the event, its rules, its safety, its prices and its refund policy.

3. Accounts

  • You must be at least 18, or the age of majority where you live, to create an account. A parent or guardian can add a minor as a profile they manage and is responsible for that minor’s use of trackReg.
  • Give accurate information and keep it up to date.
  • Keep your password and devices secure. You are responsible for what happens in your account, and should tell us at once if you think someone else has used it.

4. Drivers

  • When you register for an event, your contract for the entry is with the club that runs it. The club’s event rules, eligibility requirements, waiver and refund policy apply.
  • Give each club accurate information, including about your experience, your vehicle and your licenses, because clubs rely on it to keep events safe.
  • Questions about an entry, a refund or an event go to the club first. See Refunds and cancellations.

5. Clubs

  • A club is responsible for its events and everything it publishes on trackReg: event details, prices, eligibility rules, waivers, and its refund and cancellation policy, which it must show drivers before they pay.
  • The club is the seller of its entries, memberships and gift cards, and is responsible for delivering them, for refunds, credits and chargebacks on them, and for any taxes on them.
  • The club is responsible for the content of its waivers and for confirming they are suitable and enforceable where its events take place. trackReg collects and stores signatures but does not give legal advice.
  • The club must use drivers’ information only to run its events and membership, in line with the law and its own privacy policy, and must send messages through trackReg only to people who have agreed to receive them.
  • The club must have the permits, insurance and sanctioning its events need.

6. Payments

Payments made through trackReg go to the club’s own account. Payment processing services for clubs on trackReg are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement (together, the “Stripe Services Agreement”). By agreeing to these terms or continuing to take payments through trackReg, a club agrees to be bound by the Stripe Services Agreement, as Stripe may modify it from time to time. As a condition of trackReg enabling payment processing services through Stripe, the club agrees to give us accurate and complete information about itself and its business, and authorizes us to share it and transaction information related to its use of the payment processing services provided by Stripe.

  • Drivers authorize the charge shown at checkout. trackReg never charges drivers a booking fee.
  • A saved card can be charged for a balance on an entry the driver agreed to, such as a remaining balance after a deposit, and a declined charge may be retried.
  • Refunds and credits are issued by the club under its policy, back to the original payment method or as a credit.

7. Fees

Clubs pay the fees in the pricing terms and in any written agreement with us. Card processing is billed to the club by the payment processor. We will give at least 30 days’ notice of any change to our fees, and a change never applies to a transaction already completed. Fees are in US dollars unless agreed otherwise and do not include taxes.

8. Motorsport risk and waivers

Motorsport is dangerous. Driving, riding in, working at or watching an event can cause serious injury, death and damage to property. Your participation is your own decision and at your own risk, under the club’s rules and the waiver you sign with the club. Waivers you sign on trackReg are agreements between you and the club, and the event organizers and venues it names; trackReg is not a party to them. We do not inspect vehicles, tracks, venues or equipment, and we do not verify the experience, licenses or conduct of drivers, instructors or staff.

9. Emails and text messages

We send emails about your account and entries, and emails and texts you choose to receive. Our text message program is described in the SMS terms: reply STOP to opt out and HELP for help. Message and data rates may apply.

10. Acceptable use

You agree not to:

  • break the law, or help anyone else to, through trackReg;
  • give false information, or register or sign for someone without their permission;
  • send spam, or message people who have not agreed to receive messages;
  • upload anything unlawful, infringing, harassing or harmful, or any malware;
  • access accounts or data that aren’t yours, test or bypass our security, or overload the service;
  • scrape, copy or resell trackReg, or use it to build a competing product.

11. Your content

You keep ownership of the information, files and photos you or your club put into trackReg. You give us permission to host, copy, process and display them as needed to run trackReg for you and the clubs you deal with, under our Privacy Policy. You confirm you have the right to share them.

12. Our property

trackReg, its software, design and brand belong to Oversteer Labs LLC. We give you a limited, revocable right to use trackReg under these terms. If you send us feedback, we may use it without owing you anything.

13. Suspension and closing accounts

You can close your account at any time. We may suspend or close an account, or remove an event or content, if it breaks these terms, puts others at risk, or if the law requires it. When a club’s account closes, the club remains responsible for refunds and obligations on events it already sold. Sections that by their nature should survive, such as fees owed, disclaimers, limitation of liability, indemnity and governing law, survive the end of this agreement.

14. Disclaimers

trackReg is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t promise that trackReg will be uninterrupted or error-free, and we are not responsible for events, for clubs’ or drivers’ conduct, or for the content clubs publish.

15. Limitation of liability

To the fullest extent the law allows, Oversteer Labs LLC and its members, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, or for any personal injury or property damage arising from an event, however caused. Our total liability for any claim relating to trackReg is limited to the greater of the fees you paid to trackReg in the 12 months before the claim and US $100. Some places don’t allow these limits, so they may not all apply to you.

16. Indemnity

You agree to defend and indemnify Oversteer Labs LLC against claims, losses and costs, including reasonable legal fees, arising from your use of trackReg, your breach of these terms, or, for a club, its events, its content and its dealings with drivers.

17. Governing law and disputes

These terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law rules. Any dispute relating to these terms or trackReg will be brought only in the state or federal courts located in Georgia, and you and we agree to their jurisdiction. Before filing a claim, please contact us so we can try to resolve it informally.

18. Changes to these terms

We may update these terms. The date at the top shows when they last changed. If a change is significant, we’ll tell you by email or in the app before it takes effect, and fee changes follow the notice in section 7. Using trackReg after a change takes effect means you accept it.

19. General

These terms, with the documents they include and any written agreement with your club, are the whole agreement between you and us about trackReg. If a part is unenforceable, the rest stays in force. Our not enforcing a part is not a waiver of it. You may not transfer these terms without our consent; we may transfer them in a merger, acquisition or sale of assets.
